Photoccino Ltd. and its affiliates (“Company” or “we”) respect the privacy of its users (“User” or “you”) and are committed to protecting its Users’ information. We believe that you have a right to know our practices regarding the information we may collect and use when you visit or use our hosting, sorting, photo sharing and storing content such as images, and creating digital photo products such as photo albums, photobooks, videos and other services (the “Service”) available at [www.photoccino.com] (the “Site”) and/or any websites of third parties engaged with us (the “Publisher Websites” and the “Publishers”, respectively).

2.1 In order to access the Site and upload photos, videos, and related content, you need to set up an account on the Site. Company asks for some personal information when you create an account, including your email address and a password, which is used to protect your account from unauthorized access.
2.2 In order to purchase a product from the Site, you need to submit credit card information, a shipping address, and a billing address.
3.1 We use personal information collected on the Site to provide the Services and otherwise process transactions on the Site, to provide support for the Services, to respond to user requests and inquiries, to maintain a record of our dealings with Site users, to facilitate your use of, and our administration and operation of, the Site; to develop new products and services and to inform users about information, events, promotions, products or services we think will be of interest.
3.2 When you use the Site, Company’s servers automatically record certain information about your use. Similar to other web services, Company records information such as account activity (including storage usage and number of log-ins), data displayed or clicked on (including UI links); and other log information (including browser type, IP-address, date and time of access, cookie ID, and referrer URL).
4.2 We may share personal information with third-party vendors who assist us in performing internal functions necessary to operate our business. These functions may include, for example, analyzing traffic information or other data, providing marketing assistance, mailing items, processing credit card transactions, and fulfilling or delivering orders. In all cases we limit the information shared with our third-party vendors to that which is necessary to carry out those functions. We are not responsible for any additional information you provide to these parties, and we encourage you to become familiar with their practices before disclosing information directly to them.
4.3 You understand that when you use the Site, information you post in any public areas of the Site, as well as any information you share with individuals through the Site, will be available to other users and in some cases may be publicly available. We recommend you be cautious about giving out personal information to others or sharing personal information in public or private online forums. We are not responsible for the actions of any third parties with whom you share personal information.
4.4 We also disclose personal information when we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request; (b) enforce applicable Terms, including investigation of potential violations thereof; (c) detect, prevent, or otherwise address fraud, security or technical issues; (d) protect against harm to the rights, property or safety of Company, its users or the public as required or permitted by law; (e) to initiate, render, bill and collect for amounts owed to us; (f) or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. In addition, information about our customers, including personally identifiable information, may be disclosed as part of any merger, acquisition, debt financing or sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personally identifiable information could be transferred to third parties as one of our business assets.
5.1 Users who view your albums will see information about you including your photos, your name, a link to your profile, and your linked photo galleries. Your selected username may appear as part of the page URL.
5.2 Your public albums may be indexed and discoverable in third party services, such as search engines.
5.3 Users may comment on or “like” content in your albums; these comments or likes can be seen by anyone who visits your albums.
5.5 We may review the content of a photo album if a user complaint is received, or if we have reason to believe that the account is used in violation of our Terms.
6.1 You may change your account information and other settings by clicking the "Settings" link in the top right hand corner of a page on the Site.
6.2 If you designate an album "Public", anyone who visits your public gallery will see your album. If you designate an album "Limited" those photos will not appear in your public gallery but can be seen by someone who knows the URL. If you designate an album "Restricted," and you grant a particular user access to that album, then anyone who visits that album must enter a username and password before it can be viewed. If you designate an album “Only You,” the album will only be visible to you when signed into your account.
6.3 When you delete content or accounts in your photo albums, residual copies of deleted photos, associated data, or accounts may take up to 60 days to be deleted from Company’s active servers and may remain in our backup systems.
We have put into place reasonable security measures in an effort to prevent loss, misuse and alteration of information while it is under our control. We cannot, however, guarantee the protection of information against interception, misappropriation, misuse or alteration, nor can we promise that your information may be not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. Furthermore, we have no control over the security of other sites you might visit, interact with or do business with.
